A Legal Victory For Antiguan Doctor

ST. JOHN’S, Antigua, March 11 2015 – A local doctor on Wednesday won a legal battle with this country’s Medical Council.

The Court of Appeal ordered the Council to immediately reinstate the license of Dr. Jose Humphreys.

The Medical Council had refused to renew the doctor’s license when it expired on the 14th of September last year.

Humphreys took the Council to court over the matter.

The process began in the High Court where Justice Brian Cottle refused to grant interim relief in the form of an injunction ordering the Medical Council to give Humphreys a license while his case was being heard.

Justice Cottle had ruled that Dr. Humphreys posed a risk to the public and was unqualified.

The doctor appealed that decision and his lawyer Dr. David Dorsette said the Court of Appeal has overturned Judge Cottle’s ruling and declared there was absolutely no basis on which a court could have made such a finding.
